TERMS AND CONDITIONS

 

NOVA Parties wants all our guests to have a great experience at your event. To ensure things go smoothly we are providing our services under these terms and conditions and we kindly request that you and your guest are aware and comply to the best of your ability.

Please read these terms and conditions carefully prior to booking with NOVA Parties. These terms entail how we will provide our services and what will happen in the event of common issues.


About these terms and conditions

By submitting a retainer fee and reserving NOVA Parties services you are indicating you agree and accept our terms and conditions.

Booking and Payment

 

“Booking” means procuring specific services for a specific time and date. 

“Retainer Fee” means a non-refundable fee to hold your time and date on our book. 

“Payment” means the amount due to pay for the entirety of your services after the retainer fee has been paid. 

To book a party with NOVA Parties Or NOVA FOAM please visit our website and fill out a booking form for the fastest service. Bookings can also be made via the above phone number or email address.
Bookings are not confirmed until the reservation retainer fee is paid. We book on a first come first serve basis and we are not able to hold dates or times without the retainer fee.
The retainer fee is 50% of the service(s) cost. The retainer fee is non-refundable but serves to hold your time and date.
NOVA Parties accept payment via credit card or cash only. Full payment for your event is due 72 hours prior to your event or cash upon arrival of our crew/artist/entertainers. 

We do not offer refunds of any kind once payment has been made regardless of the situation. We understand situations arise that will either require the Client to cancel or reschedule their event and although we are empathetic to those situations, we are unable to refund any payments made. When we accept an order or reservation, we begin working immediately on selecting the best design and decor and timely delivery of materials or turn away other opportunities to honor your reservation. 


Cancellations

 

ALL EVENTS, PERFORMANCES, OR INSTALLATIONS ARE RAIN OR SHINE. We will not cancel for weather unless there is a State issued State of Emergency order. As a best practice, unless your reservation is for a specific outdoor activity please have an alternative indoor venue available for your events.
Outdoor activities such as foam parties and bubble gardens, reservations can be rescheduled due to inclement weather for up to 12 months from the originally scheduled date. A rescheduled date must be mutually agreed upon and is subject to our availability on a first come first serve basis.
Full payment will be due if you cancel less than 72 hours in advance. Our hard-working entertainers block out their schedule and turn away work to hold the dates for your party. This policy ensures they can continue to make a living wage and bring our community great entertainment!

If for ANY REASON you need to cancel, please give as much notice as possible.

Face Painting, Glitter Tattoos, and Henna

HEALTH & SAFETY

 

 We have high standards regarding hygiene and Health & Safety practices. If sponges are used we use a clean sponge for each face; brushes are cleaned regularly throughout each event. All equipment and paints are cleaned thoroughly after each event.

 To ensure we can keep our hygiene practice maintained, we have a strict policy that no one, other than the artist touches the paints, brushes, and other products being used. Please ensure children are supervised at all times.

  For safety and insurance reasons we are strictly unable to paint anyone under the age of 36 months. This is in line with the manufacturer's recommendation. We can not make any exceptions to this as that would invalidate our insurance.

  Please note, that all cosmetic products, on rare occasions can cause skin reactions. Therefore we highly recommend that people with skin allergies or sensitive skin should either, not participate or have a patch test at the beginning of the event. The decision to take part is at the individual's and/or responsible adult's discretion. The paints and products used are all professional cosmetic grade and therefore have been tested and meet FDA requirements. However, people with allergies should take caution with anything they may apply to their skin. We cannot be held responsible for skin reactions.

  Face and body artists are booked on the basis of providing an entertainment activity only. Artists are NEVER to be asked to “look after”, “keep an eye on” or supervise any children at any time. All children remain the responsibility of the parent, guardian, or event host.

 We do not serve anyone who presents as unwilling to take part. This includes sleeping children. Children must be able to sit still unaided by the parent/carer.

 In the interest of everyone's health and safety, we will not be able to serve anyone who appears ill, suffering from cold sores, broken skin, or any contagious condition due to contamination of paints and products. We hold the right to refuse to serve anyone whom we feel may put themselves, others, or our equipment at risk by cross-contamination.

 We reserve the right to cease painting if the conduct of anyone in attendance acts in a way that the face painter feels inappropriate or causes harm or may cause harm to the people taking part, the artist, or the artist’s equipment.

  For private parties and events, it is the responsibility of the organizer to obtain permission from parents/carers for all children expected to take part.

 We are unable to take responsibility for the welfare or safety of any person waiting in line or saving places for anyone. Please ensure children are supervised at all times.

 We request that anyone wishing to have their face painted should be ready to take part with a clean dry face. Children with dried food, drool, and runny noses can not be painted until their face has been cleaned and dried by their accompanying adult.

 We request that participants do not eat or drink whilst taking part as this could contaminate the paints and products, as well as slow down the queue as the artist will then need to clean any food spills or wait for participants to stop chewing. We can not paint moving faces.

 Please ensure adequate lighting and that the artist is positioned at the furthest possible distance from any sound systems and/or physical activity i.e. children running/playing, ball games etc where the artist maybe accidentally knocked.

FOAM and Bubble Parties

 

You the Customer and your guests are participating in a “FOAM PARTY” or “BUBBLE PARTY” at your own risk, which you voluntarily assume. Although we have taken precautions to make this party safe and enjoyable, we cannot and do not guarantee that accidents or other mishaps, perhaps resulting in serious injury will not occur. If you or anyone in your party have any doubts or misgivings about your/their safety, well-being, or personal property, you have the right to not participate in this event, by not entering into the premises, designated foam area, or other area where foam might reach.

By hosting a foam party you agree to release, discharge, and forever hold harmless, and to indemnify, NOVA Parties, its employees, affiliates, owners, agents, and representatives from and against any and all claims, demands, damages, fees, actions, causes of action of whatever nature and costs and expenses, including attorney’s fees, whether in contract or in tort, in law or in equity, liquidated or unliquidated, which may arise out of or relate in any way to the Event, by any local, county state or federal agency and expressly including personal injury of any nature or property damage that may be suffered or incurred, by the Customer, members of his or her family, and any and all guests, invitees, licensees, contractors or subcontractors, agents or representatives of Customer, and agrees that NOVA Parties shall not be responsible in any way for any claims related to any such injury, damage or law enforcement action. The release and indemnity agreement in this paragraph shall apply to all injury, damage, or law enforcement action, whether caused by the fault or negligence of NOVA Parties, or otherwise.

All participants should take extreme caution, the floor and other surfaces may become slippery. Please govern yourself accordingly. The undersigned (customer) agrees to inform all participants in their party of all potential hazards and precautions and furthermore accepts responsibilities for all that participate.

Although the foam used is considered safe, persons with allergies, skin disorders, open wounds, or any other ailments or conditions should consult a doctor before entering the foam. All persons should avoid eye contact and take foam internally. The foam may cause dermatitis, in certain individuals if left on the skin for an extended amount of time. On completion of the Event, Removal of wet clothing, bathing, and using a moisturizer is recommended.

The amount of foam that stays in a designated area can vary greatly, depending on factors such as temperature, humidity, type of water (hard or soft), floor surface, and number of people dancing in foam. High temperatures, porous floors, and large amounts of people will result in faster dissipation of foam. NOVA Parties makes no guarantees regarding the amount of foam generated or the length of time that foam will last in a dance floor environment. You must protect your floors. Foam can damage anything that regular water will.

 

 

Balloons

By using this service you agree to be fully responsible for these balloons and for ensuring proper balloon safety at your event.
Balloons pop, it’s an unfortunate truth. NOVA Parties can not and will not be responsible for any damaged or popped balloons once the balloon has been delivered to the site or guest. 

Our balloons are 100% latex and can trigger an allergic reaction for anyone with a latex allergy. You may not use our services if you are allergic to latex. You cannot provide balloons to anyone with a known latex allergy. If you have an allergic reaction, seek medical treatment immediately.

All children will be monitored when playing with balloons. The manufacturer suggests children under 8 be closely supervised and children under 3 should not be permitted to have balloons at all as they are a serious choking hazard. Children will not be allowed to chew on or put the balloons in their mouths.   

Balloons will always be kept away from pets and animals. Popped balloon fragments will always be picked up and disposed of in a proper trash receptacle. 

SENSORY WARNING: Balloons can be a highly sensitive play activity. Parents should be considerate of children with sensory issues when playing with balloons. Balloons can squeak and pop randomly while playing.

 There are many variables that can affect the float/display time of your balloon decor including but not limited to weather, rain, wind, and extreme heat. Please be aware of this if you are reserving a date for an outdoor installation.

Repairs/Changes: Thank you for understanding that once we have installed the decor we cannot return to fix, replace, or adjust the arrangements. We will work with you to ensure all items are placed according to your preference with regard to location, spacing, style, etc. However, once our team has professionally installed the decor and left the premises the job is considered complete.



 

Balloon Releases

 

Although balloon releases are intended to remember someone lost, support a cause, show respect for someone or something, and much more, NOVA Parties will not participate in balloon releases of any kind, regardless of the number of balloons requested. NOVA Parties will not fill orders for anyone intending to release the balloons. Releasing balloons is detrimental to our environment in many ways. Balloons float hundreds if not thousands of miles and when they land, they run a chance of landing in the ocean, in areas where livestock could accidentally eat them, or anywhere else as litter. We do not support, do not fill orders for, and advise against participating in any balloon releases.


 

Ownership of Equipment & Materials

 

All equipment, materials, and props used for the installation, are the sole property of NOVA Parties and are used on a rental basis only.

The Client is responsible for access to retrieve said equipment, materials, and props after the event.

Agreeing to the Terms & Conditions makes the Client solely responsible for the equipment, during and after the event, until surrendered back to NOVA Partes.

Failure to return any equipment or materials results in the Client being solely responsible for the property of NOVA Parties and agrees to have the card on file charged or be sent an invoice and agrees to pay for a replacement.

Any damage or vandalism that occurs to any of the property of NOVA Parties during the event, including any damage or vandalism that occurs due to the Client’s guests, will result in the Client accepting sole responsibility for the property of NOVA Partes and agrees to have the card on file charged or be sent an invoice and agrees to pay it. This includes but is not limited to misuse, theft, or disasters (fire, flood, earthquake).

 

Venues

 

It is the Client’s sole responsibility to confirm if the venue allows for the service to be provided and if adequate utilities such as water or power are available prior to any payment made to NOVA Parties. If the Client fails to confirm the venue’s rules or utilities prior to making any payment(s), and we are not able to perform the services said payment(s) will be forfeited and considered non-refundable.

It is the Client’s responsibility to make arrangements for NOVA Parties to gain/maintain access to the venue. The Client is also responsible for obtaining any permits, access passes, gate/room access cards, or wristbands for the entire staff, as well as notifying NOVA Parties of any room changes within the venue, if applicable, with at least 24 hours notice. Access arrangements apply to access prior to the event for installation, for performance services, as well as access to strike, if applicable, or breakdown of any props, designs, equipment, etc. If props/designs/equipment are transported by the Client, the Client may return said items to NOVA Parties the following day.


 

Professional Conduct

 

Our entertainers will arrive prior to the agreed-upon start time of your service to set up.
Our entertainers will provide all necessary equipment such as tables, chairs, tents, and all specialty equipment unless otherwise agreed upon.
Our entertainers can not perform in direct sunlight, if your outdoor venue does not have shade, please provide tent shades or let us know ahead of time so we may bring them instead.

NOVA Parties reserves the right to move your start time by 15 minutes if the venue of your event is inside or within 10 miles of the Washington DC Beltway. We don’t enjoy doing this and will make every effort to start on time but sometimes the traffic is unpredictable.
NOVA Parties entertainers are not child care providers and children must be supervised at all times.


Photography 

 

All designs/displays installed or created by NOVA Parties artists are the property of NOVA Parties, as such NOVA Parties reserves the right to utilize or take any/all photographs and video recordings as deemed necessary, for promotional use. This also includes any personal photographs or video recordings taken by the Client or the Client’s guests. NOVA Parties reserves the right to include the official NOVA Parties logo on any personal photographs or video recordings made, from a NOVA Parties installation or event.



 

Waiver of Liability

 By booking NOVA Parties either by verbal or digital communication you agree to release, indemnify and hold harmless NOVA Parties or its shareholders, employees, and sub-contractors against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by you or anyone on your behalf, including attorney's fees and related costs. If litigation arises pursuant to any claims made by you or by anyone else acting on your behalf, if NOVA Parties incur any of these types of expenses, you agree to reimburse NOVA Parties.
