NOVA Parties Terms and Conditions

NOVA Parties is committed to delivering exceptional event services. These Terms and Conditions outline the agreement between NOVA Parties and the client to ensure a smooth event experience.

By submitting payment or a retainer fee, you confirm that you have read, understood, and agreed to these Terms and Conditions.

1. Booking and Payment

Booking Definition: Securing specific services for a set time and date.
Payment Definition: The total amount required for the agreed-upon services.

  • Bookings are confirmed only upon receipt of full payment. NOVA Parties operates on a first-come, first-served basis and cannot hold dates without payment.

  • Payment Methods: Payments can be made via credit card, cash, or check (checks accepted from corporate entities only). Personal checks will not be accepted.

  • Non-Refundable Payments: All payments are final and non-refundable, regardless of circumstances.

  • Large Event Payments: For bookings exceeding $2,000, a 50% deposit is required at the time of booking, with the balance due no later than 7 days before the event. Late payments may result in cancellation without refund.

  • Outstanding Balances: Any balance not paid by the due date will be subject to cancellation and loss of reservation.

  • Additional Fees: Late payments, returned checks, or last-minute changes may incur additional fees.

2. Cancellations and Rescheduling

Weather & Force Majeure Policies

Rain or Shine Policy
All events are conducted rain or shine, unless a state-issued State of Emergency is in effect.
For weather-sensitive activities, such as foam parties or bubble parties, clients may reschedule within 12 months of the original booking if it rains on the day of the event, pending availability.

Winter Weather Policy (January 1st – March 31st)
Events impacted by severe winter weather may be rescheduled without penalty. Rescheduling requests must be made at least 12 hours prior to the event. If a mutually agreed date cannot be determined, the payment will be retained as a credit valid for 12 months.

Client-Initiated Rescheduling & Cancellations

  • All other events must be rescheduled at least 8 days before the event. Rescheduling is subject to availability and a $100 rescheduling fee may apply.

  • No refunds will be provided for client-initiated cancellations. Payments may be held as a credit for future services at NOVA Parties' discretion.

  • NOVA Parties is not responsible for cancellations or delays caused by circumstances beyond our control (natural disasters, government restrictions, transportation disruptions, etc.). In these cases, payments will be retained as credits valid for 12 months.

3. Event Requirements

Venue, Setup & Cleanup

  • The client is responsible for confirming venue policies, securing permits, and ensuring adequate utilities (e.g., power, water).

  • NOVA Parties must have appropriate access to the venue for setup, performance, and breakdown.

  • If venue restrictions or lack of utilities prevent service delivery, payments will not be refunded.

Parking and Load-In

  • Parking fees or restrictions at the venue are the client’s responsibility.

  • NOVA Parties staff must have close access for loading and unloading.

4. Client and Guest Conduct

  • Clients and guests must treat NOVA Parties staff and equipment with respect.

  • Abusive behavior, harassment, or intentional damage will result in immediate termination of services without refund.

  • NOVA Parties entertainers are not childcare providers; children must be supervised.

  • The client is responsible for informing guests of potential hazards related to specific services.

5. Liability & Insurance

Waiver of Liability

By booking NOVA Parties, you release, indemnify, and hold harmless NOVA Parties from all claims, suits, or actions related to injuries, damages, or losses sustained during your event.

Insurance Requirements
For large-scale or high-risk events, clients may be required to provide proof of liability insurance, naming NOVA Parties as an additional insured. This will be communicated before booking if applicable.

6. Photography & Digital Media Release

  • NOVA Parties retains ownership of all designs, displays, and digital content captured at events.

  • By booking, clients grant NOVA Parties the implied right to use event photos and videos for promotional purposes across all media platforms.

  • If a client does not want photography of their event, they must notify NOVA Parties in writing prior to the event.

  • NOVA Parties will remove photos or videos upon request but is not required to obtain advance consent for photography at public or private events.

7. Service-Specific Policies

Foam & Bubble Parties

  • Foam parties do not pose a greater slipping risk than regular water play, but caution should always be exercised.

  • Our foam solution is hypoallergenic per the manufacturer; however, guests with sensitive skin should consult NOVA Parties staff before participation.

Face Painting, Glitter Tattoos, & Henna

  • Services are available only for participants over 36 months of age.

  • All products are cosmetic-grade and safe for skin, but reactions are possible. Guests should request a patch test if concerned.

Magic Snow & Special Effects

  • Magic Snow works in all temperatures and is not typically slippery. Precautions are taken to prevent excessive accumulation.

8. Equipment & Material Responsibility

  • All equipment, materials, and props remain the property of NOVA Parties.

  • If a client damages or loses NOVA Parties' equipment, they must replace it at full retail value. NOVA Parties will provide an invoice from the manufacturer/supplier.

  • NOVA Parties reserves the right to charge a good faith deposit on rentals over $500.

9. Chargeback Policy

By agreeing to these Terms and Conditions, the client waives the right to initiate a chargeback for payments made in accordance with our policies. Any disputes must be resolved directly with NOVA Parties.

10. Acknowledgment & Jurisdiction

By submitting payment, the client confirms they have read, understood, and agreed to these Terms and Conditions. This applies whether payment is made online, via invoice, or in person.

This agreement is governed by the laws of the Commonwealth of Virginia. Any disputes will be resolved exclusively in the courts located in Loudoun County, Virginia.
